Terms of Service
Effective date: 6 July 2026
1. Introduction
These Terms of Service govern your access to and use of Bibliomatica, the AI-powered bibliometric analysis platform operated by Workcyte Digital Academy (SSM Registration No. 202603071928), a business enterprise registered in Malaysia. By creating an account, subscribing to a plan, or otherwise using the Bibliomatica service, you agree to these Terms. If you do not agree, do not use the Service.
2. Definitions
"Account" means your registered user account with Bibliomatica. "Content" means data you upload, generate, or store through the Service, including bibliographic corpora, analysis outputs, and manuscripts. "Subscription" means a paid access plan to the Service. "Third-Party Services" means external services and APIs the Service depends on or integrates with, including OpenAlex, ROR, ORCID, and Large Language Model providers you choose to connect via your own API keys. "BYOK" means "bring your own key", the model under which you provide your own credentials to Large Language Model providers.
3. Account Registration
You must be at least 18 years old to create an Account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. Notify us immediately at security@bibliomatica.app if you suspect unauthorized access. You provide us with your email address for authentication via magic link, and optionally your name during onboarding. You are solely responsible for the security, cost, and terms of any Third-Party Service credentials (BYOK API keys) you connect to the Service. We store your BYOK API keys encrypted at rest using AES-256-GCM and use them only to fulfil requests you initiate through the Service.
4. Subscription and Billing
The Service is offered on a subscription basis. PRO Monthly is RM49 per month for Malaysian users (billed via CHIP) or USD 15 per month for international users (billed via Stripe). For Malaysian users paying via FPX or QR, your subscription requires manual renewal each cycle. We send reminder emails at T-7, T-3, T-0, and T+3 days relative to your period end. If you do not renew by T+3, your Account transitions to read-only access (see Section 5). For users paying via credit or debit card, your subscription auto-renews at the end of each period unless cancelled. All prices are exclusive of applicable taxes.
5. Cancellation and Refund
You may cancel your Subscription at any time through your Account settings or by emailing support@bibliomatica.app. Upon cancellation, your Account remains at full access until the end of your current billing period, then transitions to read-only status. You retain indefinite access to view and download all Content you created during your Subscription. You may resubscribe at any time to restore full access. Refunds are governed by our Refund Policy at https://bibliomatica.app/refund. All sales are final; no refunds are issued on Subscription payments.
6. Acceptable Use
You agree not to use the Service in violation of applicable law; reverse-engineer, decompile, or attempt to derive the source code of the Service; interfere with, disrupt, or attempt to overload the Service or its infrastructure; share, resell, or sublicense access to the Service to third parties; use the Service to create derivative bibliometric analysis products for commercial resale; circumvent any usage limits or entitlement gates; or upload Content you do not have the right to process. You must comply with the terms of any Third-Party Service you connect via BYOK, including LLM providers' usage policies. Bibliomatica is not responsible for your Third-Party Service accounts, costs, or terms.
7. Intellectual Property
You retain all rights, title, and interest in your Content. By using the Service, you grant Bibliomatica a limited, non-exclusive, worldwide, royalty-free licence to process, store, transmit, and display your Content solely to provide the Service to you. Bibliomatica retains all rights, title, and interest in the Service, including its software, methodology, user interfaces, and documentation. You may not use Bibliomatica trademarks, logos, or brand assets without written permission. Analysis outputs derived from your Content (citation counts, network structures, generated manuscripts) belong to you.
8. Third-Party Services
The Service integrates with external services including OpenAlex, ROR, ORCID (public academic metadata APIs); Large Language Model providers you connect via BYOK (such as OpenAI, Anthropic, Google); and payment processors (Stripe for international, CHIP for Malaysia). Bibliomatica is not responsible for the availability, accuracy, or terms of Third-Party Services. Your use of Third-Party Services is subject to their respective terms and policies.
9. Warranties Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. BIBLIOMATICA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. Bibliomatica computes bibliometric values from Third-Party Service data using deterministic software; however, we do not warrant the accuracy or completeness of underlying source data (such as OpenAlex records or DOI resolutions), nor the acceptance of any manuscript prepared using the Service by any publisher or reviewer. Methodological choices and interpretations remain your responsibility.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BIBLIOMATICA, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES. BIBLIOMATICA'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Malaysian law, including under the Consumer Protection Act 1999.
11. Term and Termination
These Terms apply from the date you create an Account until terminated. You may terminate at any time by cancelling your Subscription and deleting your Account. We may suspend or terminate your Account and access to the Service if you materially breach these Terms, with reasonable notice where feasible. Sections 7, 9, 10, 13, and 14 survive termination.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia, with venue in Negeri Sembilan.
